The rate covers the days worked, with no salary, pension or paid holiday behind it.

How an interim DPO is paid, and why the unit is the day
The law allows a DPO from outside the organisation.
Under Article 37, the DPO may be a staff member or fulfil the tasks on the basis of a service contract.
The ICO says you can contract out the role to an individual or an organisation, and that an externally appointed DPO has the same position, tasks and duties as an internal one.

An interim DPO holds the seat for a defined period: the gap after a departure, a remediation programme, a run of impact assessments or a breach and its aftermath.
The interim invoices for the days worked, or is paid through an agency’s payroll.
That makes the day rate the real unit of pay.
There is no salary, no employer pension and no paid holiday, and the interim carries the gaps between assignments.
Across all functions, the Institute of Interim Management’s 2026 survey puts the average assignment at 10.0 months, the average gap between assignments at 3.2 months and the average days billed in a year at 148.
An interim who works through their own company pays themselves through salary and dividends from what the company earns, after its costs and Corporation Tax.
The day rate is the company’s income, not the interim’s take-home pay.

How to hire an interim data protection officer
1. Define the mandate and its end
Say what the interim must deliver and by when: a cleared backlog of subject access requests, a set of impact assessments, a response to the ICO, a handover to a permanent hire.
Then estimate the days.
2. Decide IR35 status at the start
If your business is medium or large, you make the status determination for the engagement and give the interim your reasons.
Settle it before you go to market, because it changes the rate candidates quote.
3. Check for conflicts
Article 38 lets a DPO take on other tasks only if they do not create a conflict of interests.
Ask what else the interim does, and for whom, before you agree the rate.

Day rates as each publisher states them. IT Jobs Watch: advertised contract rates in IT job ads, 14 quoted in the six months to 5 Oct 2026, IR35 status not stated. Robert Walters: its 2026 survey’s PAYE contract rates for a DPO, by region; it has no London DPO row. Barclay Simpson’s 2026 data privacy guide does not use the DPO title: its rows are the privacy roles around the seat. The IIM figures cover every interim function.

Interim pay and IR35: who decides, and what it changes
Tax status turns on how the engagement runs, not on the title or the contract alone.
Under the off-payroll working rules (IR35), a medium or large client makes the status determination; for a small client outside the public sector, the interim’s own company decides.
The rules apply contract by contract, so one interim can have engagements on both sides.

The IIM’s 2026 survey puts the average interim day rate at £949 outside IR35 and £830 inside, across all functions.

The interim DPO day rate in IT job ads has a median of £525, and the middle half of the 14 quoted rates runs from £513 to £566 (IT Jobs Watch, six months to 5 October 2026).
London ads give the same £525 median; ads outside London give £500.
The sample is small, so treat it as a guide to the advertised market.
Robert Walters’ 2026 survey gives wider PAYE bands for a DPO: £500–£800 a day in the South (Robert Walters’ average £700), £550–£750 in the Midlands (average £650) and £450–£800 in the North (average £630).
It has no London DPO rate.
For the privacy roles around the seat, Barclay Simpson’s 2026 guide gives contract rates of £450–£550 for a privacy manager, £500–£750 for a privacy lead and £900–£1,200 for a group or global head of privacy.
In its survey, 54% of employers named specific projects as their main reason for using contractors.

No interim is paid a salary, but the day rate can be compared with one.
At the £525 median, 220 days would bill £115,500.
At the IIM’s all-function average of 148 days billed in a year, the same rate bills £77,700.
Both are our arithmetic, a comparison and not a salary.
A full month of interim cover, at about 22 working days and the £525 median, comes to £11,550 (our arithmetic).
That is the client’s cost.
The interim pays their own pension, holidays, insurance and the gaps between assignments out of it.
For scale, IT Jobs Watch’s median advertised salary for a permanent DPO is £45,000 over the same six months, before employer’s National Insurance and pension.
