A data protection officer does not have to be a full-time employee.
The ICO’s guidance says a DPO can be an existing employee or externally appointed.
A fractional DPO is appointed for part of the week, usually through their own company, and invoices for the days worked.
The post keeps its weight at any number of days.
Under Article 38 of the UK GDPR, the DPO reports directly to the highest management level and must not be dismissed or penalised for performing their tasks.
Under Article 37, a public authority must designate one, as must a business whose core activities involve large-scale monitoring or large-scale processing of special category data.
No independent source publishes what a fractional DPO charges.
The figures that exist are DPO-as-a-service providers’ own price lists, which are not a market reading.
So this page does one thing it can stand behind: it spreads the permanent salary across working days and labels the result as our arithmetic.
A pro-rata figure is a floor for comparison, not a quote.
A day rate has none of an employee’s pension, paid holiday or employer’s National Insurance behind it, so a quote and a pro-rata figure measure different things.

How to hire a fractional DPO
1. Count the days the work needs
List what the DPO must own: the record of processing, data protection impact assessments, breach handling, subject access requests and board reporting.
Estimate the days a month it takes.
The days set the cost; the risk of the processing sets the seniority.
2. Ask for quotes, not a benchmark
Ask each candidate for a day rate, the days a week or month, the notice period and how urgent work outside those days is charged.
Compare the quotes with the pro-rata figures below.
3. Settle IR35 and VAT before the rate
IR35 is decided by how the engagement runs, and a medium or large client makes the status determination (HMRC).
If the DPO’s company is registered for VAT, VAT is added to each invoice.
